Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Tallyvox website, scans, reports, dashboards, portals and related services (together, the “Services”). By using the Services you agree to these Terms. If you are using them for an organization, you agree on its behalf.
1. Who we are
The Services are provided by Tallyvox, operating from the United States. We operate from the United States and can provide our Services to businesses anywhere in the world; where local law gives you additional rights, nothing here removes them.
2. What we provide
Tallyvox measures whether a business is named in the answers that AI engines give (visibility scans and audits), and does off-site presence work to improve that visibility (monthly retainers). Reports are descriptive of what we measured, on the stated dates, using the stated method and engines.
3. How to read our numbers
We work hard to move the count and we show the movement honestly. AI answers vary between engines and over time, so no Tallyvox report, projection or statement is a guarantee of rankings, a visibility percentage, or any specific outcome in an AI answer. Every figure traces to a scan, a run and a cited source; that is the product.
4. Fees, retainers and the audit
Current prices are shown on our pricing page and in the proposal for your engagement. The audit is a one-off purchase; its fee credits 50% toward your first retainer month if a retainer starts within 30 days. Retainers run for a three-month initial term, then month-to-month with two weeks’ notice to cancel. Fees are exclusive of any taxes that apply to you. Where an engagement has its own signed agreement, that agreement controls if it conflicts with these Terms.
5. Your content and data
You keep every report, list and stored answer we produce for you. You are responsible for the information you submit (company, website, industry, contact details) and confirm you may share it with us. You grant us the limited licence needed to run the Services and produce your deliverables. We handle personal data as described in our Privacy Policy.
6. Acceptable use
Don’t use the Services to break the law, infringe others’ rights, probe or disrupt our systems, resell scans without agreement, or misrepresent our reports as guarantees. We may suspend access for conduct that puts the Services, our other customers, or third parties at risk.
7. Intellectual property
Tallyvox, the Tallyvox brand, the platform, and our methodology are our property. We grant you a limited, non-exclusive right to use the Services and your deliverables for your own business. Third-party names and marks that appear in a report belong to their owners and are used only to describe what we measured.
8. Third-party engines and infrastructure
Our measurements observe third-party AI engines (such as Claude, ChatGPT, Gemini, Perplexity, Google AI Mode and Google AI Overview). We don’t control those engines and aren’t responsible for their outputs or availability. The Services also rely on infrastructure and email providers that process data on our behalf, as described in the Privacy Policy.
9. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant any particular visibility result. Nothing here excludes a liability that cannot be excluded under applicable law.
10. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or lost profits or revenue. Our total liability arising out of or relating to the Services is limited to the fees you paid us for the Services in the three months before the event giving rise to the claim.
11. Term and termination
You may stop using the Services at any time; retainer cancellation follows section 4. We may suspend or end access if you materially breach these Terms. On termination, the licences here end, but you keep the deliverables already produced for you.
12. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules, except where mandatory local law where you live provides otherwise.
13. Changes
We may update these Terms as the Services evolve. Material changes will be reflected by the “last updated” date above; continued use after a change means you accept the updated Terms.
